The axiom of the entire medical profession is “to do the patient no harm”. This is really a safety issue for all patients who receive medical care and treatment. Medical malpractice happens when there was a departure from acceptable medical practices and the departure caused the patient harm.

There are many types of medical malpractice cases. Our practice focuses on certain types of medical malpractice. Specifically, we focus on cancer, surgical and unnecessary or harmful medical treatments. No one is more devastated than the patient who gets a "clean bill of health" from their doctor only to learn a year or so later that their doctor missed a serious or life threatening medical condition or what has now become a permanent medical condition.

Cancer can often be misdiagnosed in many ways. Sometimes a malignant tumor is misidentified as benign, or a benign tumor is misidentified as malignant. Biopsy specimens are interpreted wrong by the pathologist or even if read correctly, the primary doctor fails to follow up or have the patient come back for timely additional testing. Sometimes, a cancerous lesion is completely overlooked or missed. A patient who is at an increased risk of developing cancer because of a family history is not thoroughly screened or tested. Sometimes unnecessary surgery is performed or necessary surgery is delayed or not performed at all.

Misdiagnosis or the failure to diagnose a serious medical condition takes place far more frequently than most people actually realize until it happens to you or a loved one. Sometimes the misdiagnosis or failure to diagnosis a patient’s medical condition does not have any harmful medical consequences to the patient. This is often because the undiagnosed illness, disease or condition can still be timely treated and corrected without any harm to the patient.

In far too many other instances, the misdiagnosis or failure to timely diagnosis a serious medical condition in the patient can be a cause of serious irreversible worsening of the medical condition or illness. The delay in diagnosis can take away or reduce the chances of the patient being cured or of living longer. This kind of delay usually leaves the patient in a much worsened condition. It can change the patients’ treatment options or it can change the ultimate outcome of the disease process. In more serious instances, the delay can be a cause of the patient passing on before their time.

The errors and mistakes that lead to a delay in a proper and timely diagnosis can also cause a postponing of critical and proper medical treatment for months or even years. We all know that Cancer treatments are most effective when they begin early in the disease process. The failure to timely diagnose cancer also postpones the start of treatment. The postponement of critical treatment affects a positive outcome or result for the patient. This decrease in a positive outcome or result often causes harm to the patient.

In addition to the delay in medical treatments, a cancer misdiagnosis can have devastating financial and emotional consequences. Not only is the patient affected and harmed but their entire family is swept up by additional anxiety and helplessness because of a more serious illness than it should have been without the medical malpractice. The patient and their loved ones are often facing uncharted territory made much worse by the misdiagnosis or the delayed diagnosis of cancer and the inevitable delay of critical medical treatment.

All surgery has risks but any increase of the risks or the failing to explain those risks to the patient may be medical malpractice if harm results. If surgery or medical care is found to be unnecessary or was performed poorly that may be the basis for a medical malpractice action.

There are many medical providers who are involved in a surgery case. Often, the surgery will be in a hospital, a patient will have a surgeon or surgeons, sometimes residents in training, several nurses, an anesthesiologist and perhaps a nurse anesthetist who all participate in different ways during the surgery.

Because of the numerous ways to make medical errors and mistakes by any of these individuals during and sometimes after the surgery, a check list of the possible medical errors and mistakes is not possible on a simple webpage.
