The axiom of the entire medical profession is “to do the patient no harm”. This is really a safety issue for all patients who receive medical care and treatment. Medical malpractice happens when there was a departure from acceptable medical practices and the departure caused the patient harm.

No one is more devastated than the patient who gets a "clean bill of health" from their doctor only to learn a year or so later that their doctor missed a serious or life threatening medical condition or what has now become a permanent medical condition. Same holds true for what should have been a routine surgery that turns out to be anything but routine.

In far too many instances, the misdiagnosis or failure to timely diagnosis a serious medical condition in the patient can be a cause of serious irreversible worsening of the medical condition or illness. The delay in diagnosis can take away or reduce the chances of the patient being cured or of living longer. This kind of delay usually leaves the patient in a much worsened physical and emotional condition. It can change the patients’ treatment options or it can change the ultimate outcome of the disease process itself. In more serious instances, the delay or misdiagnosis can be a cause of the patient passing on before their time had a proper or timely diagnosis been made. 

The errors and mistakes that lead to a delay in a proper and timely diagnosis can also cause a postponing of critical and proper medical treatment for months or even years. We all know that Cancer treatments are most effective when they begin early in the disease process. The failure to timely diagnose cancer also postpones the start of treatment. The postponement of critical treatment affects a positive outcome or result for the patient. This decrease in a positive outcome or result often causes harm to the patient.

In addition to the delay in medical treatments, a cancer misdiagnosis can have devastating financial and emotional consequences. Not only is the patient affected and harmed but their entire family is swept up by additional anxiety and helplessness because of a more serious illness than it should have been without the medical malpractice. The patient and their loved ones are often facing uncharted territory made much worse by the misdiagnosis or the delayed diagnosis of cancer and the inevitable delay of critical medical treatment.
